ASIC Breach Reporting Trends Put Professional Risk Back Under the Microscope

Why stronger governance, faster notification and clearer cover checks matter for Australian service businesses

The information on this website is general in nature and does not take into account your objectives, financial situation, or needs. Consider seeking personal advice from a licensed adviser before acting on any information.

Following recent complaints data, fresh industry attention on ASIC’s reportable situations regime is another reminder that professional risk rarely appears without warning.
Breach reporting, client complaints, remediation delays and internal control failures can all become early indicators of a larger professional indemnity exposure, particularly for firms that provide financial advice, credit assistance, compliance support, accounting, consulting or outsourced professional services.

The key issue for Australian businesses is not simply whether a breach has occurred. It is how quickly the problem is identified, recorded, escalated and communicated. Under ASIC’s regime, Australian financial services and credit licensees must report certain significant breaches and investigations. While the formal obligation applies to regulated licensees, the underlying discipline is relevant far more broadly: if a client later alleges poor advice, misleading information, administrative error or failure to act, the quality of a firm’s records may strongly influence how defensible the claim becomes.

For professional indemnity insurance buyers, this creates a practical renewal question. Does your policy reflect how your business now operates, or how it operated when cover was first arranged? Many small businesses have changed materially in recent years by adding digital delivery, new subcontractors, automated workflows, cross-border clients or higher-value engagements. Each change can alter the claims profile, even when the core professional service looks familiar.

Business owners may wish to use the latest breach-reporting focus as a prompt to review:

  • Notification obligations: understand when a complaint, error or potential circumstance must be reported to the insurer, even before a formal claim arrives.
  • Policy alignment: check that covered professional services, client types, revenue, jurisdictions, subcontracting arrangements and limits of indemnity remain accurate.
  • Evidence quality: maintain clear engagement letters, advice files, version histories, file notes, approvals and client communications.

This is particularly important because professional indemnity policies are commonly written on a claims-made basis. Timing, retroactive dates and known circumstances can affect whether a later claim is considered under the policy. A slow internal response may not only worsen client harm; it may also complicate the insurance position.

Where there is uncertainty, businesses should speak with insurance brokers before renewal or immediately after identifying a potential issue. The aim is not to overreact to every operational mistake, but to build a disciplined process that protects clients, preserves evidence and gives the policy the best chance of responding if a claim emerges.

For consultants, advisers and professional service firms, the message is clear: breach management is now part of insurance readiness. Strong systems, transparent records and properly matched professional indemnity cover can make a substantial difference when a client concern becomes a formal allegation.

Recent industry attention on insurance claims handling has put a practical issue back in front of Australian households: a policy is only as valuable as the support it provides when a claim is made. Fresh industry data has again put the spotlight on the financial health of Australia's life insurance sector, with the latest APRA reporting indicating that insurers remain in a more stable position than during the most difficult years of claims volatility and pandemic disruption. For households, however, the important message is not simply whether insurers are profitable. It is whether the cover sitting behind a mortgage, young family, business loan or superannuation account is still suitable, affordable and clearly understood. - read more

Fresh insurance industry concern about underinsurance is especially relevant for Australian farmers as rebuilding and replacement costs remain stubbornly high. While the issue is often discussed in relation to houses, the same pressure applies across rural assets: sheds, fencing, pumps, tanks, grain storage, livestock yards, irrigation equipment and machinery can all cost significantly more to replace than they did when a policy was first arranged. - read more

Australia’s insurance complaints environment remains a useful warning sign for real estate agencies, particularly those relying on multiple policies across professional indemnity, public liability, cyber, office contents, business interruption and commercial motor cover. Recent dispute trends reported through the financial complaints system continue to show that customers are most likely to become frustrated when claims are delayed, declined, poorly explained or affected by policy exclusions they did not fully understand at the outset. - read more
