Recent insurance market commentary has again highlighted a growing challenge for Australian professional service firms: cyber incidents are no longer just an IT problem.
When a system outage, data handling error, failed implementation, software defect or poor security recommendation causes a client financial loss, the dispute can quickly move into professional indemnity territory.

That matters for consultants, IT providers, managed service businesses, accountants, marketing agencies, compliance advisers and other firms that rely on digital tools to deliver advice or services. A client may not frame the problem as a cyber event. They may allege that the professional failed to design an adequate process, gave unsuitable advice, overlooked a foreseeable risk, delayed a critical response or breached a contractual service standard.

This is where policy boundaries can become uncomfortable. Cyber insurance is generally designed to respond to certain network, privacy and incident response costs. Professional indemnity insurance is focused on claims arising from covered professional services, errors, omissions or breaches of duty. In practice, a single digital failure may involve elements of both. If cover has been arranged in isolation, gaps, overlaps and disputes over which policy should respond may emerge at the worst possible time.

For small businesses, the risk is amplified by the way technology is now embedded in everyday work. Cloud platforms, client portals, automated workflows, artificial intelligence tools, outsourced developers and third-party software can all affect service delivery. Even if the original fault sits with a supplier, clients may still look to the professional who recommended, configured, monitored or relied on that system.

The practical lesson is not to assume that a standard policy will automatically keep pace with digital exposure. Firms should review how their services are described in their professional indemnity schedule, whether technology-related work is included, how contractual liability is treated, and whether cyber exclusions could restrict cover. Notification obligations also matter, particularly where a client complaint, security concern or system failure may later become a formal claim.

It is also worth checking limits. A technology-related loss can spread across multiple clients, making aggregation wording and defence costs especially important. Businesses can estimate an appropriate professional indemnity limit as a starting point, but policy wording and occupation details still need careful review.

As digital risk becomes part of ordinary professional practice, the strongest position is a joined-up approach: clear contracts, documented advice, tested incident procedures, current cyber controls and insurance that reflects the work actually performed. For firms unsure how their policies interact, professional assistance can help identify whether the protection matches the real exposure.
